Terms of Service

These Terms of Service ("Terms") govern your use of the EventPro Bartender application ("App"), operated by EventPro Bartender LLC ("we," "us," or "our"). By accessing or using the App, you agree to these Terms.

1. Nature of the Service

The App is under active and ongoing development, which means features may change, be added, or be removed over time, and you may occasionally encounter bugs or errors. You understand and agree that:

• The App may contain bugs or errors

• Features may change or be removed as the product evolves

• The App is not guaranteed to be uninterrupted or error-free

We are committed to preserving the data you create in the App. We will not wipe, reset, or delete your organization's data in the ordinary course of operating or updating the App. (Routine deletion you initiate, deletion on your request, or deletion after account closure is covered in Section 10 and the Privacy Policy.)

2. Intended Use

The App is designed to help you organize and manage event-related information, but it should not be relied on as your sole system for business-critical decisions. You are responsible for:

• Reviewing and verifying all data

• Maintaining backups of important information

• Double-checking calculations, quantities, and schedules

 

3. User Accounts

To use the App, you may be required to create an account. You agree to:

• Provide accurate information

• Keep your login credentials secure

• Notify us if you believe your account has been compromised

You are responsible for all activity that occurs under your account. If you create or join an organization, you acknowledge that other members of that organization may have access to data within that organization.

 

4. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose

• Attempt to access data belonging to other organizations or users

• Reverse engineer, decompile, or disassemble any part of the App

• Interfere with or disrupt the App or its infrastructure

• Use the App to store or transmit malicious code or harmful content

 

5. Data & Privacy

We collect and store certain information to operate the App, including event details, client contact information, staff information, and beverage/inventory data that you enter into the App. Our use of your data is governed by our Privacy Policy, which is incorporated into these Terms. We do not sell your data.

 

6. Payment Terms

Access to the App's paid features requires a subscription, billed through our payment provider, Clerk. By subscribing, you authorize recurring charges to your payment method.

• Subscription rate. Your subscription rate is the rate presented to you at checkout and shown in your account's billing settings. We will provide advance notice by email before any change to your rate takes effect.

• Recurring billing. Subscriptions are billed on a recurring basis and renew automatically until cancelled.

• No refunds. All payments are non-refundable. We do not provide refunds or credits for partial billing periods, unused time, or features you choose not to use.

• Cancellation. You may cancel at any time. When you cancel, your access to paid features continues through the end of your current paid period, after which your account moves to the free tier.

• Your data on the free tier. If your subscription lapses, is cancelled, or is downgraded, your organization's data is retained. You lose access to paid features until you resume payment, but we do not delete your data because your subscription ended.

 

7. No Guarantees

The App is provided "as is" and "as available", without warranties of any kind. We do not guarantee that:

• The App will be error-free

• The App will meet your specific needs

• Any information provided by the App is accurate or complete

 

8. Limitation of Liability

To the fullest extent permitted by law, EventPro Bartender LLC and its owners are not liable for any damages resulting from your use of the App, including but not limited to:

• Lost profits

• Lost data

• Missed events

• Business interruptions

• Incorrect calculations or recommendations

Your use of the App is at your own risk. You agree to indemnify and hold harmless EventPro Bartender LLC from any claims arising from your use of the App or your violation of these Terms.

 

9. Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us permission to use them without compensation or obligation to you.

 

10. Termination

We reserve the right to:

• Suspend or terminate access to the App at any time

• Modify or discontinue the App without notice

You may stop using the App at any time. If you would like a copy of your data, you may request it (see our Privacy Policy); upon request we will provide your data within 30 days. Following account closure, data may be removed in accordance with our Privacy Policy.

 

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes means you accept the updated Terms.

 

12. Governing Law & Disputes

These Terms are governed by the laws of the state of California, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in San Joaquin County, California.
